IN NO EVENT SHALL COSTA VIDA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO COSTA VIDA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
This limitation of liability applies regardless of the legal theory under which the claim is asserted, whether in contract, tort (including negligence), strict liability, or otherwise, even if Costa Vida has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so the above limitations may not apply to you in their entirety.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms or to any transactions conducted through our website.

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT, IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA) THEN IN EFFECT. The arbitration shall be conducted in English, and the arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
The arbitration shall be conducted on an individual basis. You and Costa Vida each waive the right to participate in any class action, class-wide arbitration, or any other representative action or proceeding. You agree that you may only bring claims against Costa Vida in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
You have the right to opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by sending written notice to [email protected]. If you opt out, you and Costa Vida will resolve disputes in court as provided in Section 10.
11.3 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in a small claims court of competent jurisdiction for disputes or claims that fall within the jurisdictional limits of such court, provided the matter remains in small claims court and is not removed or appealed to a court of general jurisdiction.
